This Website (“Website” or “Site”) is owned and operated by Wi-Fi Alliance Services (“Wi-Fi Alliance Services,” “us,” or “we”). Use of this Website is conditioned upon your acceptance of the terms and conditions below (the "Terms"). By using this Site, you acknowledge that you agree to these Terms. These Terms are subject to change from time to time, so you should review them for changes periodically. Use of the Website after such changes constitutes your acceptance of the Terms in effect at the time of such use.

1. Restrictions on Use of Materials

Except as expressly authorized by prior written consent from Wi-Fi Alliance Services, no material from this Site or any Website owned, operated, licensed, or controlled by Wi-Fi Alliance Services may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your internal non-commercial use only, provided that you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of Wi-Fi Alliance Services’ copyright and other proprietary rights. For the purposes of these Terms, the use of any such material on any other website or networked computer environment is prohibited. All products, processes, technologies, information, software, artwork, text, video, audio, pictures, images, banners, custom graphics, button icons, scripts, logos, and other content on the Website, including all associated intellectual property rights, are the proprietary property of Wi-Fi Alliance Services, its licensors, or are used under principles of fair use, and protected by copyright and other intellectual property laws, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Wi-Fi Alliance Services. The trademarks, service marks, and logos (the “Trademarks”) used and displayed herein are registered Trademarks of Wi-Fi Alliance Services.  Nothing herein should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed herein, without the written permission of Wi-Fi Alliance Services. The Trademarks may not be used in connection with any product or service in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Wi-Fi Alliance Services. Other products or company names used on the Site may be the trademarks of their respective owners. Should any viewer of any Wi-Fi Alliance Services published document, including this Site, respond with information including feedback data, such as questions, comments, suggestions, or the like regarding the content of any such Wi-Fi Alliance Services document, such information shall be deemed to be non-confidential and Wi-Fi Alliance Services shall have no obligation of any kind with respect to such information and shall be free to reproduce, use, disclose and distribute the information to others without limitation. Further, Wi-Fi Alliance Services shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products incorporating such information.

2. Website Code of Conduct

By using our Website, you agree to comply with these Terms and to follow our Website Code of Conduct, which is set out below. Under this Website Code of Conduct, you will not:

  • Use the Website in a manner that could disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.

  • Reverse engineer the Site.

  • Seek to obtain access to any material or information that we have not intentionally made available to you on the Website through “hacking,” “scraping,” or other means.

As part of its activities, Wi-Fi Alliance Services provides links to the sites that it believes may offer useful information that is related to its mission. These sites are not affiliated with Wi-Fi Alliance Services. Wi-Fi Alliance Services is not responsible for the content of such other sites and shall not be liable for any damages or injury arising from users’ access to such sites. In addition, those sites are not subject to these Terms or any additional policy that Wi-Fi Alliance Services may implement from time to time. You are responsible for determining the applicable use terms and policies, if any, that may apply to your use of those sites.

4. Links to This Site; Web Services

Subject to any additional rights or restrictions set forth in any separate linking agreements regarding this Site that you may have entered into with Wi-Fi Alliance Services, you may provide links to this Website provided that you adhere to the following requirements: (i) any link to the Website must be a text only link clearly marked "Wi-Fi Alliance Services Website," (ii) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Wi-Fi Alliance Services’ names and marks, (iii) the link must "point" to www.wi-fi.com and not to other pages within the Website, (iv) the appearance, position and other attributes of the link may not create the false appearance that your organization or entity is sponsored by, affiliated with, or associated with Wi-Fi Alliance Services, (v) when selected by a user, the link must display the Website on full-screen and not within a "frame" on the linking Website, and (vi) Wi-Fi Alliance Services reserves the right to revoke its consent to the link at any time and in its sole discretion.

You may not access any page on this Site or any information or data contained on or accessible through this Site for the purpose of providing any form of service for your internal use or for the use of any third party unless you have entered into a written agreement, such as a portal agreement, with Wi-Fi Alliance Services for this purpose.

5. Accuracy of Information

Wi-Fi Alliance Services has developed this Site as a service to the members of Wi-Fi Alliance and the general public, and it endeavors to keep the information on the Site up to date. However, the information may nevertheless become out of date over time. Wi-Fi Alliance Services shall not be liable for any inaccuracy or incompleteness of this Site or for the failure to update the information contained on this Site. Information about companies other than Wi-Fi Alliance Services contained on the Site should not be relied upon as being provided or endorsed by Wi-Fi Alliance Services.

6. Third-Party Information and Materials

This site may contain information and materials that third parties have provided to Wi-Fi Alliance Services ("Third-Party Content"). Wi-Fi Alliance Services does not independently verify Third-Party Content, makes no representation as to its accuracy, and assumes no responsibility for your use of the Third-Party Content and any consequences of that use, including, without limitation, any damages, injuries, or results that may result from its use. You understand that the information and opinions in the Third-Party Content represent solely the thoughts of the author and are not endorsed by Wi-Fi Alliance Services, nor does such Third-Party Content necessarily reflect Wi-Fi Alliance Services’ beliefs.

7. Copyright Notification

Wi-Fi Alliance Services respects the intellectual property rights of others. Upon proper notice, Wi-Fi Alliance Services will remove Third-Party Content that violates copyright law or suspend any user who repeatedly submits Third-Party Content in violation of copyright law.

Pursuant to 17 U.S.C. §512, Wi-Fi Alliance Services has implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with such law. If you believe your work has been used in a way that constitutes copyright infringement, please send Wi-Fi Alliance Services’ copyright agent, identified below, a notification of claimed infringement with all of the following information (“Notice of Infringement”) via fax or mail: (a) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (b) identification of the claimed infringing material and information reasonably sufficient to permit Wi-Fi Alliance Services to locate the material on its website; (c) information reasonably sufficient to permit Wi-Fi Alliance Services to contact you, such as an address, telephone number, and, if available, an e-mail address; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (e) a statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf; and (f) your physical or electronic signature.

8. Advertisers

The Site may contain advertising and sponsorships. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site is accurate and complies with applicable laws. Wi-Fi Alliance Services is not responsible for the illegality or any error, inaccuracy, or problem in any advertiser's or sponsor's materials.

9. Registration

Certain sections of, or offerings from, the Site may require you to register. If registration is requested, you agree to provide us with accurate, complete registration information.  Each registration is for your personal use only and not on behalf of any other person or entity. You are responsible for preventing such unauthorized use.

10. Unlawful Activity

Wi-Fi Alliance Services reserves the right to investigate complaints or reported violations of these Terms and to take any action Wi-Fi Alliance Services deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your  e-mail addresses, usage history, posted materials, IP addresses, and traffic information.

11. Indemnification

You agree to indemnify, defend and hold Wi-Fi Alliance Services and its partners, agents, officers, directors, employees, subcontractors, successors, assigns, third-party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates harmless from any and all liabilities, losses, claims, suits, actions, damages, and/or expenses, including reasonable attorneys’ fees, incurred by Wi-Fi Alliance Services related to your violation of these Terms or use of the Site.

12. Third-Party Services

Wi-Fi Alliance Services may allow access to or advertise certain third-party product or service providers ("Merchants") from which you may purchase certain goods or services. You understand that Wi-Fi Alliance Services does not operate or control the products or services offered by Merchants and does not assume responsibility for any content, opinions, or materials available from them. Wi-Fi Alliance Services does not endorse the goods or services of any Merchant, nor does Wi-Fi Alliance Services warrant that a Merchant site will be free of computer viruses or other harmful code that can impact your computer or other Web-access device. If you link to any Merchant site or any other third-party site through our Site, please be aware that you are doing so at your own risk. Merchants are responsible for all aspects of order processing, fulfillment, billing, and customer service. Wi-Fi Alliance Services is not a party to the transactions entered into between Merchants and you. YOU AGREE THAT USE OF OR PURCHASE FROM SUCH MERCHANTS IS AT YOUR SOLE RISK AND IS WITHOUT WARRANTIES OF ANY KIND BY US, EXPRESSED, IMPLIED OR OTHERWISE INCLUDING WARRANTIES OF TITLE, FITNESS FOR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES IS WI-FI ALLIANCE SERVICES LIABLE FOR ANY DAMAGES ARISING FROM THE TRANSACTIONS BETWEEN MERCHANTS AND YOU OR FOR ANY INFORMATION APPEARING ON MERCHANT SITES OR ANY OTHER SITE LINKED TO THE WI-FI ALLIANCE SERVICES SITE.

13. Third-Party Merchant Policies

All rules, policies (including privacy policies), and operating procedures of Merchants will apply to you while on any Merchant sites. Wi-Fi Alliance Services is not responsible for any information exchange between Merchants and you. Wi-Fi Alliance Services and the Merchants are independent contractors and neither party has the authority to make any representations or commitments on behalf of the other.

14. Privacy Policy

The Wi-Fi Alliance Services Privacy Policy, as it may change from time to time, is a part of these Terms and may be found at www.wi-fi.com.

15. Payments

You represent and warrant that if you are purchasing something from Merchants or Wi-Fi Alliance Services that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.

16. Purchases and Promotions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions, or other similar features, all of which terms are made a part of these Terms by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the latter terms shall control with respect to your use of that portion of the Site or the specific service.

Wi-Fi Alliance Services’ obligations, if any, with regard to its products and services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such agreements.

Wi-Fi Alliance Services may make changes to any products or services offered on the Site, or to the applicable prices for any such products or services, at any time, without notice. The materials on the Site with respect to products and services may be out of date, and Wi-Fi Alliance Services makes no commitment to update the materials on the Site with respect to such products and services.

17. Warranty Disclaimer

THE INFORMATION AND MATERIALS ON THIS SITE ARE PROVIDED "AS IS" AND ON AN “AS AVAILABLE” BASIS, AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WI-FI ALLIANCE SERVICES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WI-FI ALLIANCE SERVICES DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS OR ERRORS WILL BE CORRECTED, OR THAT THIS SITE AND/OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WI-FI ALLIANCE SERVICES DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIALS ON THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU EXPRESSLY AGREE THAT USE OF THE WI-FI ALLIANCE SERVICES WEBSITE AND RELATED SERVICES IS AT YOUR OWN RISK. APPLICABLE LAW MAY NOT ALLOW FOR THE EXCLUSION OF CERTAIN WARRANTIES, SO PORTIONS OF THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR DOWNLOAD AND USE OF ANY WI-FI ALLIANCE SERVICES APPLICATION IS AT YOUR SOLE DISCRETION AND RISK AND THAT THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR MOBILE DEVICE, OR OTHER DEVICE, OR LOSS OF DATA THAT RESULTS FROM SUCH USE.WI-FI ALLIANCE SERVICES FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH RESPECT TO THE APPLICATION, THE APPLICATION IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, LIFE SUPPORT SYSTEMS, EMERGENCY COMMUNICATIONS, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL SYSTEMS, OR ANY OTHER ACTIVITIES IN WHICH THE FAILURE OF THE APPLICATION COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. APPLICABLE LAW MAY NOT ALLOW FOR THE EXCLUSION OF CERTAIN WARRANTIES, SO PORTIONS OF THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

18. Government Users

The materials, information, and data on this Site are prepared entirely at private expense and are "commercial items" as that term is defined in 48 C.F.R. 2.101. Consistent with 48 C.F.R. 12.212 and 48 C.F.R 227.7202-1 through 227.7202-4, use by the United States government of this Site is subject to the limitations in these Terms.

19. Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT, OR NEGLIGENCE, SHALL WI-FI ALLIANCE SERVICES (WHICH INCLUDES FOR PURPOSES OF THIS SECTION, ITS EMPLOYEES, AFFILIATES, SUPPLIERS, AGENTS, CONTRACTORS, OR OTHER THIRD PARTIES MENTIONED AT THE WI-FI ALLIANCE SERVICES SITE) BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM SERVICES, PRODUCTS OR CONTENT OBTAINED FROM THE SITE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF, OR RELATED TO, THE USE OF OR THE INABILITY TO USE THE INFORMATION OR MATERIALS CONTAINED ON THIS SITE, WHETHER THE INFORMATION OR MATERIALS CONTAINED ON THE SITE ARE PROVIDED BY WI-FI ALLIANCE SERVICES OR BY A THIRD PARTY, AND EVEN IF WI-FI ALLIANCE SERVICES OR ITS AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION WILL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT AND, TO THE EXTENT PERMITTED BY LAW, WILL APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL WI-FI ALLIANCE SERVICES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, CLAIMS, AND CAUSES OF ACTION RELATED TO OR ARISING OUT OF THE WI-FI ALLIANCE SERVICES SITE OR ANY PROGRAMS OR SERVICES YOU RECEIVE FROM THE SITE, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE EXCEED THE AMOUNT PAID TO WI-FI ALLIANCE SERVICES, IF ANY, FOR ACCESSING THIS SITE DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR FIFTY DOLLARS, WHICHEVER IS GREATER. YOU AGREE THAT WE WOULD NOT ENTER INTO THESE TERMS AND CONDITIONS WITHOUT THESE LIMITATIONS ON OUR LIABILITY. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

20. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by destroying all materials obtained from any and all Wi-Fi Alliance Services Site(s) and all related documentation and all copies and installations thereof, whether made in accordance with these Terms or otherwise. These Terms will terminate immediately without notice from Wi-Fi Alliance Services if, in Wi-Fi Alliance Services' sole discretion, you fail to comply with any term, condition, or provision of these Terms. Upon termination, you must destroy all materials obtained from this Site and any and all other Site(s) of Wi-Fi Alliance Services and its affiliates and all copies thereof, whether made in accordance with these Terms or otherwise.

21. Jurisdiction and Other Matters

This Site is controlled by Wi-Fi Alliance Services from its offices within the State of Texas, United States of America. Wi-Fi Alliance Services makes no representation that materials on the Site are appropriate or available for use in other locations. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Use of the Wi-Fi Alliance Services Site will require your device(s) to have access or connection via mobile network or Internet (fees may apply). Because use of the Site involves hardware, software and Internet access, your ability to use the Site may be affected by the performance of these factors. Wi-Fi Alliance Services does not guarantee that this Site can be accessed on all devices. By accepting these terms and conditions, you acknowledge and agree that complying with such system requirements, which may be changed from time to time, are your responsibility and that your use of any third-party services are subject to the terms and conditions of use established by the respective third-party service providers. 

These Terms shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without reference to any conflict of law principles. You hereby consent to the venue in and jurisdiction of the state and federal courts sitting in the State of California. Notwithstanding anything to the contrary, Wi-Fi Alliance Services shall have the right to elect in its sole discretion the forum for any lawsuit arising hereunder brought by Wi-Fi Alliance Services. Because you shall have access to the trademarks and other valuable proprietary materials of Wi-Fi Alliance Services, you agree that Wi-Fi Alliance Services shall have the right to enforce these Terms and any of its provisions by injunction (without being required to show any actual damage or to post an injunction bond), specific performance or any other equitable relief without prejudice to any other rights and remedies that Wi-Fi Alliance Services may have for the breach of these Terms. In the event of a claim, dispute, or controversy arising under, out of or in connection with these Terms of Use, you and Wi-Fi Alliance Services shall attempt to resolve such claim, dispute or controversy by conducting good faith negotiations. If the parties hereto are unable to resolve the matter within twenty (20) business days following good faith negotiations, either party may file a lawsuit in a state or federal court sitting in the State of California. Any claim or cause of action arising out of or related to your use of the Services or these Terms must be filed by you within one year after such claim or cause of action arose or be forever barred.  Wi-Fi Alliance Services’ failure to act, and/or delay in acting, with respect to enforcing any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of any other right hereunder.

If any provision of these Terms is for any reason found by a court of competent jurisdiction to be unenforceable, the remainder of these Terms shall continue in full force and effect. This is the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Wi-Fi Alliance Services may revise these Terms at any time by updating this posting. If we modify these Terms, any such modifications will take effect proactively, upon your subsequent access to the Website. You should visit this page from time to time to review the then-current Terms because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages at the Wi-Fi Alliance Services Site. These Terms shall not be assignable by you, either in whole or in part. Wi-Fi Alliance Services reserves the right to assign its rights and obligations under these Terms.

The following provisions shall survive the termination of these Terms of Use and shall apply indefinitely:
